Why Buoyancy Certification Matters

Under the Merchant Shipping (National Small Vessel Safety) Regulations, 2007, all vessels must have sufficient buoyancy. This is a fundamental safety requirement — a vessel with inadequate buoyancy can capsize and sink rapidly in the event of an incident, with potentially fatal consequences.

Buoyancy Requirements Under South African Law

The buoyancy requirements for your vessel depend on its category, size, and intended use. Key points:

  • All vessels — including those under the Certificate of Fitness threshold — must have sufficient buoyancy
  • Buoyancy foam must be placed in the correct locations to provide positive buoyancy when the vessel is fully flooded
  • Deteriorated, compressed, or waterlogged buoyancy foam does not meet the standard — it must be in good condition

What is a buoyancy certificate?
A buoyancy certificate confirms that a vessel has sufficient buoyancy material installed and meets the buoyancy requirements set out under the Merchant Shipping (National Small Vessel Safety) Regulations, 2007. It is issued following an inspection by a qualified surveyor and is closely linked to your vessel's Certificate of Fitness.
Is buoyancy a legal requirement for my boat?
Yes. Under South African maritime law, all vessels must have sufficient buoyancy. This applies regardless of whether your vessel otherwise meets the COF or skipper's license thresholds. Operating a vessel without adequate buoyancy is dangerous and illegal.
What if my boat has no buoyancy foam?
We can fit buoyancy foam to vessels that do not currently have it. Our team assesses the vessel, determines the required foam placement and volume, installs the buoyancy material, and then certifies the vessel. This is a common service for older boats and vessels that were built before buoyancy regulations were tightened.
Can I buy a boat that fails the buoyancy requirement?
A seller may sell a non-compliant vessel only if they make full written disclosure of the non-compliance. However, it is illegal to sell a vessel without this disclosure. As a buyer, insisting on a buoyancy certificate before purchase is strongly recommended — both legally and for your safety.
Do I need a buoyancy certificate to sell my boat?
Technically, you can sell a non-compliant vessel with full written disclosure. However, having a valid buoyancy certificate makes your boat far more attractive to buyers, confirms legal compliance, and removes the liability risk. We recommend getting certified before listing your vessel for sale.
How often does buoyancy need to be recertified?
Buoyancy compliance is assessed as part of the annual Certificate of Fitness inspection. If the buoyancy material is in good condition and the vessel structure hasn't changed, it will typically pass the buoyancy component of the annual COF without additional buoyancy work.
